KICKs Usage Policy

This KICKs Usage Policy ("Policy") outlines the acceptable use of KICKs on the Kick Platform, ensuring they are used to foster a positive, engaging and safe community experience for all Users.

1. APPLICATION

This Policy applies to any User that acquires (by purchase or otherwise), licenses, interacts with, or otherwise uses KICKs. We may change this Policy from time to time with such changes effective upon messaging online or otherwise providing you an updated version. We encourage you to review this Policy on a regular basis.

Use of KICKs is further subject to and governed by Kick's Terms of Service and Community Guidelines. In the event of a conflict between this Policy and those agreements, this Policy shall prevail.

1.1. Defined terms
"Creator" means an end user who broadcasts content and may receive on-Platform recognition or commercialization in connection with the activation of Gifts.
"Gifts" are on-Platform digital experiences that are activated in exchange for KICKs, that may trigger visual effects, acknowledgements, or other non-monetary features.
"KICKs" are limited, revocable, non-transferable, non-sublicensable digital goods licensed by Kick to Users for use on the Platform. KICKs are not currency and have no cash or redemption value.
"Platform" means the Kick website, app, and the services and features Kick provides.
"Platform Features" are on-Platform, non-monetary effects or utilities provided by Kick (e.g., overlays, chat callouts, leaderboards, pinned messages).
"User" means either a Viewer or a Creator.
"Viewer" means an end user who acquires or uses KICKs and/or experiences Gifts.

2. USAGE GUIDELINES

2.1. KICKs are not a monetary instrument
KICKs are digital goods that Users may license and use on the Platform, and do not serve as a currency.

KICKs are a means to activate Gifts. The activation of Gifts (referred to on Kick as 'Gifting') is a digital experience by which Users can engage, celebrate and express gratitude within their communities.

KICKs and Gifts: (i) do not represent any balance, stored value, or property interest; (ii) cannot be exchanged for cash or items/services of value; and (iii) may be modified, discontinued, or removed by Kick at any time to the extent permitted by law.

2.2. KICKs cannot be directly exchanged for items or services of value
KICKs are not convertible to any type of currency, cannot be transferred outside of the Platform, and do not hold any monetary value. Users must not exchange KICKs for items or services that typically are associated with a cost or value.

Platform-provided features that trigger in response to Gifting, such as leaderboards and custom chat messages, are not considered an exchange of items or services of value. These are non-monetary, Platform driven benefits designed to enhance the community experience.

2.3. Permitted Activities
Users are encouraged to utilise KICKs to do the following:

  • Show appreciation, support and recognition for Creators.
  • Celebrate amazing moments alongside Creators.
  • Enjoying Platform-provided features that respond to Gifting, such as:
    • recognising Viewers that are at the top of a Creator's leaderboard for Gifting; and
    • Gifting to trigger Platform features, such as pinned messages.
  • Subject to Kick's Community Guidelines and to the prohibited activities below, participating in Platform-driven interactions in response to Gifting, such as:
    • expressions of appreciation for KICKs usage and Gifting by Viewers;
    • engaging in acknowledgements of chat messages that respond to Gifting, whether via overlays or other forms, by Viewers;
    • engaging certain activities, such as dancing and cheering, certain video game actions or gameplay, or wearing certain clothing in response to Gifting; and
    • engaging with the Platform in a certain way, such as changing an avatar or engaging with chat, in response to Gifting.

2.4. Prohibited Activities
Users must not utilise KICKs to do the following, which constitute violations of this Policy:

(a) No Off-Platform or Cash-Like Benefits

  • Users must not solicit or request use of KICKs or Gifts in exchange for money or donations.
  • Users must not sell, offer to sell, trade, barter, solicit or transfer KICKs or Gifts (which are licensed, non-transferable digital goods or experiences) to other Users in exchange for:
    • real or virtual currencies; or
    • any other items of value whether inside or outside the Platform.
  • Users must not sell, barter, promise, solicit, or provide any item or service of value ---including merchandise, subscriptions, mod roles, access to private chats/servers/content/data, shout-outs, collaborations, meet-ups, private engagements, or priority support---in exchange for use of KICKs or Gifts. Requests for such items in exchange for use of KICKs or Gifts is prohibited.

(b) Gambling & Promotions
KICKs or Gifts must not be used or activated as or in connection with: (i) bets, wagers, odds, tips, or other gambling; (ii) lotteries, raffles, sweepstakes, or giveaways requiring use of KICKs to enter; or (iii) contests or promotions unless expressly authorized by Kick and compliant with applicable law and the Terms of Service.

(c) Safety and Adult Content
Users must not encourage or perform dangerous, harmful, or illegal activities in response to use of KICKs or Gifts (e.g., binge drinking, drug use, medical claims, self-harm). Sexual conduct or nudity in exchange for use of KICKs or Gifts is prohibited. All content remains subject to the Community Guidelines and applicable law.

(d) Harassment and Abuse
Activating Gifts or Gifts-triggered messages/effects to harass, demean, or target individuals or protected classes is prohibited. Creators must use available moderation tools to remove abusive acknowledgements or overlays.

(e) Charity and Political Funding
Users must not represent use of KICKs as donations or use them for charitable or political fundraising without prior written approval from Kick and compliance with all legal requirements. Political contributions using KICKs are prohibited.

(f) Fraudulent or criminal activity
Users must not use KICKs or Gifts to engage in any fraudulent, criminal or other unauthorized activity, or solicit, use or receive KICKs or Gifts for any fraudulent, criminal or other unauthorized activity.

(g) Sanctions and Illegal Use
KICKs and Gifts must not be used in violation of sanctions, export controls, or anti-money-laundering laws, or to facilitate criminal activity. Kick may geo-restrict or disable features to comply with law.

2.5. Examples of permitted and prohibited activities
Examples of permitted and prohibited conduct are illustrative, not exhaustive. Kick may address similar conduct that undermines the purpose of this Policy.

2.6. Minors
Where available, KICKs may be acquired only by Users who are the age of majority or by minors with verifiable parental/guardian consent, as permitted by applicable law. Creators may not solicit use of KICKs from minors or condition interactions on minors activating Gifts.

2.7. Fraud, Chargebacks, and Enforcement
Kick may revoke, freeze, or remove KICKs and Gifts; reverse or withhold associated Creator commercialization; and suspend or terminate accounts where Kick suspects fraud, chargebacks, unauthorized activity, or Policy violations. Kick may offset against future payouts and pursue restitution to the extent permitted by law.

2.8. Refunds
Except where required by law, all licenses to KICKs are final and non-refundable. Where refunds are mandated, Kick may revoke any associated KICKs or Gifts and adjust related Creator payouts.

3. VIOLATIONS OF THIS POLICY

Any violations or attempted violations of this Policy by you (or any third party acting on your behalf) will constitute a violation of the Terms of Service, including this Policy, by you and a material breach of any other applicable agreement, and/or supplements to any applicable agreement(s), with Kick.

A violation may result in civil or criminal liability, and Kick, in its sole discretion, in addition to any remedy that it may have at law or in equity, may immediately terminate your license to use KICKs and/or access to the Platform. Kick may bring legal action to enjoin violations and/or collect damages caused by any violation of any part of this Policy.

Kick's failure to enforce this Policy in every instance in which it might have application does not amount to a waiver of Kick's rights.
